Terms and Conditions of Entry for the “Identity Direct” (Promotion)

 

1. Information on how to enter & prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid. By taking part in this Promotion, the Eligible Entrant acknowledges that he/she has read and consents to the terms & conditions set out below and the data collection statement published on the entry form

 

2. Entry is open to residents of Australia and New Zealand, who are aged 18 years and over, void elsewhere and/or where prohibited by law (Eligible Entrants). Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this promotion and their immediate families are ineligible to enter.

 

3. The competition commences at 12.01am AEST/AEDT on 11 July, 2016 and closes at midnight AEST/AEDT on 9 June, 2017.

 

 4. The draw will take place at 2.00pm AEST/AEDT at MDSA, 15 Grosvenor Street, Neutral Bay NSW 2089, every two months.

 

5. There will be 2 winners drawn from all eligible entries received during the promotion. Each winner will receive a $250 gift voucher.

 

6. The maximum retail value of each prize is AU $250 (OR LOCAL CURRENCY EQUIVALENT) recommended retail price (“RRP”). Prize supplier conditions apply. Total maximum prize pool value is AU $500 (OR LOCAL CURRENCY EQUIVALENT).

 

7. The winner/s will be notified by phone and in writing (email) within 2 working days of the draw date and their name and locality will be published 2 days after the draw date for a minimum of 28 days, on https://www.winatidentitydirect.com.au/

 

8. Eligible Entrants will be required to provide all mandatory information required for an advertised promotion they enter in order to complete their entry. Entrants are subject to all notices posted online including but not limited to the Promoter's Privacy Policy and Data Collection Statement

 

9. To enter and be eligible to win, Entrants must, during the Promotion Period:

                (a) Make any Purchase from Identity Direct (and associated businesses) via their webpage, catalogue order form or by phone;or

                (b) Register on www.winatidentitydirect.com.au (registration is free) (Registration) or

                (c) Sign up to receive Identity Direct emails or

                (d) Update customer details or complete a survey initiated by an Identity Direct email (limited to 1 entry per survey) or

                (e) Submit a product review to the Identity Direct website (limited to 1 entry per review).

  

10. The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these competition conditions, forfeiting or not claiming a prize. For any prize that remains unclaimed or forfeited through ineligibility or otherwise, the Promoter may conduct an unclaimed prize draw at the same time and place as the original draw, three months after the original draw date, to distribute any prizes unclaimed by that date, subject to any applicable law. The first valid entry drawn will win an unclaimed prize. The winner will be notified by email within 2 business days of the draw and will be announced 2 days after the draw date for a minimum period of 28 days on https://www.winatidentitydirect.com.au/

 

11. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process, or for submitting an entry that is not in accordance with these Conditions of Entry

 

12. Prize is not transferable & cannot be taken as cash, unless otherwise stipulated. In the case that a prize includes alcohol Northern Territory residents will not be eligible to receive the prize. Legal aged consumers should be advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Alcohol Guidelines at https://www.nhmrc.gov.au/your-health/alcohol-guidelines

 

13. No responsibility is accepted for lost entries. Any entry not complying with these terms and conditions is invalid.

 

14. If any of the prizes are unavailable, for whatever reason, the Promoter reserves the right to substitute any of the prizes for a prize of equal or greater value, subject to state regulation and subsequent approval.

 

15. Prizes are subject to availability

 

16. Entrants can only enter in their own name and use their own email address. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. The Promoter reserves the right to validate and check the authenticity of any prize claim or entry before awarding a prize. Multiple entries accepted, however each entry must be submitted separately and must independently comply with these Conditions of Entry. All entries have an equal chance of winning. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.

 

17. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete or incomprehensible entries will be deemed invalid. No responsibility will be taken for lost, late or misdirected entries. 

 

18. Programming and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these conditions of entry, all valid prize claims in excess of the advertised prize pool will be honoured.

 

 19. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the Prize.

 

20. All existing claims for prizes and entitlements to claims will be met notwithstanding the advertised prize pool have been exceeded.

 

21. Printing errors or other quality control matters outside the control of the individual entrant shall not be used as the sole basis for refusing to award a prize.

 

22. The prize must be taken as offered and cannot be varied. Prize values are GST inclusive and are in Australian dollars and are the recommended retail value as provided by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in prize value.

 

23. The Promoter’s decision in relation to any aspect of the competition is final and binding on every person who enters and no correspondence will be entered into.

 

24. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit. Once prizes have left Promoter's premises, the Promoter will not be responsible for any delay in delivery, or failure of safe delivery of prizes.

 

25. Prize winners are advised that Tax implications may arise from their prize winning and they should seek independent financial advice prior to the acceptance of the prize.

 

26.       The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.  

 

27. The Promoter is not responsible for any incorrect or inaccurate information or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

 

28. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion.  The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

 

29. All entries become the property of The Promoter. Eligible entrants consent to the use and disclosure of their information for the purposes of this competition by The Promoter and its agents associated with this competition. Eligible persons agree that by submitting an entry, you agree that the Promoter may use your email address to send information and promotions concerning third party products and services and also supply your contact information and questionnaire responses to companies so that they may use them to contact you by mail, phone, SMS, MMS or email to send offers and promote services based on your preferences. If entrants do not consent to their details being used for future marketing purposes, the entrant should contact The Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to The Promoter.

 

30. As a condition of entering this promotion, Eligible Entrants consent to the Promoter using the Eligible Entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) for publicity purposes in any form of media for an unlimited period of time without further notification, review, remuneration or compensation, permission or approval. Where allowable, Eligible Entrants agrees that, in the event they are the winner, the Eligible Entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.

 

31.  If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the various Lottery Departments, to cancel, terminate, modify or suspend the promotion.

 

32. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation.

34. The entrant acknowledges that by entering this competition they are providing information to the Promoter and not to Facebook. 

 

35. The Promoter may communicate or advertise this competition using Facebook.  The competition however, is in no way sponsored, endorsed or administered by, or associated with, Facebook.  Each entrant completely releases Facebook from any and all liability.
